This Privacy Notice describes the information collection, use, retention and sharing practices of Davanni’s Inc., (“Davanni’s”, “we”, “us”, “our”) and its affiliates and subsidiaries when you interact with us through our website, www.davannis.com (the “Website”), our mobile application, or other digital products on which this Privacy Notice appears (collectively, the “Sites”).

 

PERSONAL INFORMATION WE COLLECT, WHY AND FOR HOW LONG 

When you interact with our Sites, we collect your personal information. Personal information is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual. 

We will collect your personal information when you:

  • Account Registration. When you register an account with us, we collect your identifiers (full name, email address, and mobile telephone number), we also request you select a Davanni’s store location, and to create a password which will be associated with your account. We use this information to create your account, to manage your store and purchase preferences, to provide you with your order, to enroll you in our rewards program, to send you marketing and promotional communications, and to contact you regarding your order.  We automatically opt you in to signing up for Davanni’s Rewards and to receive email communications from us. You can easily opt-out of both by unchecking the boxes before you register. We retain this information for as long as you have an account with us.
  • Online Orders. You can place an order online through a registered account or as guest.  If you place an order online, you will need log into your account or provide your identifiers (full name, email address, and telephone number), and order information. If you pay online, you will need to provide your payment information (name, credit card number, expiration date, CVV, and billing zip code). We use this information to provide you with your order, to process your payment, and to communicate with your regarding your order. We retain this information for as long as you have an account with us.
  • Davanni’s Rewards. If you sign up for Davanni’s Rewards, we require you to register an account. We collect your identifiers (full name, email address, and mobile telephone number), we also request you select a Davanni’s store location, and to create a password which will be associated with your account. We use this information to link your account with the Davanni’s Reward Program. We retain this information for as long as you have an account with us.
  • Communications. If you choose to communicate with us through email, via the Sites, or any other means, we collect from your identifiers (name, email address, mobile telephone number). We use this information to communicate with you regarding your inquiry. If you have chosen to receive marketing and promotional emails or SMS messaging and no longer wish to receive them, you may click on the “unsubscribe” link in each email. Please note, we may still send you communications regarding your account or your order. 
  • Join Our Team. If you wish to apply for a position with Davanni’s, you will be directed to our third-party applicant management provider to collect your identifiers (full name, email address, and telephone number), your professional identifiers (resume), and your protected classification (whether or not you are eligible for work in the U.S.). We use this information to assess your qualifications for the position and to communicate with you regarding your application. 
  • Interact with the Services. In addition to the personal information you provide directly to us, we also collect information from you automatically as you use our Services via cookies, pixels, web beacons, and similar tracking technologies. This includes the following internet or other electronic network activity information.

    We use essential and performance cookies to collect your usage, device, and location information when you interact with the Services. We use this information to: (i) track you within the Services; (ii) enhance user experience; (iii) prevent fraudulent use of the Services; (iv) diagnose and repair Services errors, and, (v) in cases of abuse, track and mitigate the abuse. Particular third-party cookies to note on our Website include:

 

  • Google Analytics. We use Google Analytics to collect information on your use of our Website to improve our Website. In order to collect this information, Google Analytics may set cookies on your browser, or read cookies that are already there. Google Analytics may also receive information about you from applications you have downloaded that partner with Google. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to our Website is restricted by the Google Analytics Terms of Use and Privacy Policy. Generally, to prevent your data from being used by Google Analytics, you can download the Google Analytics opt-out browser add-on.

 

  • Facebook Pixel. We use Facebook Pixel to customize our advertising and to serve you ads on your social media based on your browsing behavior. This allows your behavior to be tracked after you have been redirected to our Websites by clicking on a Facebook ad. Facebook stores cookies on your device to enable us to measure the effectiveness of Facebook ads for statistical and market research purposes. We do not have access to the information collected through Facebook’s cookies. However, the information collected via Facebook, on the Website as well as other websites on which Facebook’s cookies are installed, is also stored and processed by Facebook. Facebook may link this information to your Facebook account and also use it for its own promotional purposes in accordance with Facebook’s Data Usage Policy. The Facebook cookies also allow Facebook and its partners to show you advertisements on and outside of Facebook. To opt-out of this sharing and displaying of Facebook ads, visit your Facebook Advertisement Preferences, and you can clear and control the information third parties share with Facebook in your Off-Facebook Activity If you do not have a Facebook account, you can opt-out of Facebook ads through the Digital Advertising Alliance (DAA) and its AdChoices program.

 

  • Interact with us on social media. When you interact with our fan page on social networking websites, such as Facebook, Twitter (or “X”), YouTube, TikTok and Instagram (each a “Fan Page” and collectively “Fan Pages”), we collect basic engagement metrics and use it to tailor content and marketing and use it to improve user experience as set forth in this section. Please note that we do not control the use or storage of the information that you have posted to any social networking websites. This information is collected and processed by the social networking websites for their own purposes, including marketing.   • Fan Pages. When interacting with our Fan Pages, we collect, from you, your personal identifiers (first and last name) and visual information (photograph (i.e., profile picture)), as well as any information that you provide when interacting with our Fan Pages (e.g., commenting, sharing, and rating). We use this information to advertise our products, for events and invitations, and to communicate with users via the contribution and comment function. Because our Fan Pages are publicly accessible, when you use them to interact with other users, for example by posting, leaving comments or liking or sharing posts, any personal information that you post in them or provide when registering can be viewed by others or used by them as they see fit.The content posted on our Fan Pages or other public areas of social networking websites can be deleted in the same way as other content that you have created.
  • Community Management. We collect, from you, your contact, including “likes”, shares, messages and other interactions with the content, in order to analyze and evaluate how our content is perceived, to learn from it, and to improve our public relations efforts. We use this information to create advertisements that match our Fan Page and to disseminate them via the Social Network based on demographic data.

HOW WE SHARE YOUR PERSONAL INFORMATION

 

  1. General Sharing

Davanni’s shares personal information in the following instances:

  • In the event of a corporate reorganization.   • Opt Out of Marketing Communications. You may opt out of receiving marketing emails from us by clicking the “unsubscribe” link provided at the bottom of each email we send. Please note, we may still send you notifications necessary to provide you, our services. If you have an online ordering account with us, you may also opt out by signing in and updating your account preferences or delete your account.
  • Opt Out of Other Cookies. All session cookies are temporary and expire after you close your web browser. Persistent cookies can be removed by following your web browser’s directions.
